By downloading, installing, or using the CareJan mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. CareJan is operated by CareJan LLC, a California limited liability company.
CareJan operates exclusively as a Domestic Referral Agency ("DRA") under California Civil Code Section 1812.5095. This means:
CareJan provides free tools for In-Home Supportive Services (IHSS) provider-to-recipient matching and timesheet management. CareJan will NEVER charge fees for IHSS-related matching or tools. These services are and will always remain free of charge.
CareJan does not process, submit, or guarantee any IHSS payments. All IHSS payments are administered exclusively by the State of California. The IHSS timesheet tools within CareJan are logging assistants only. Users must submit their official timesheets directly through the California State IHSS portal.
To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials.
Users register as either a "Family" (seeking care) or a "Caregiver/IHSS Provider" (offering care). Each role has distinct features and responsibilities within the platform.
CareJan reserves the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any behavior that endangers the safety of other users.
CareJan offers optional premium subscription plans ("Premium") that provide enhanced features. Premium subscriptions are billed through Apple's App Store and are subject to Apple's terms and conditions for auto-renewable subscriptions.
Premium subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. You may manage or cancel your subscription through your Apple ID account settings.
All subscription payments are processed by Apple. Refund requests must be submitted directly to Apple in accordance with their refund policies.
You agree not to:
CareJan provides tools for users to report inappropriate content and block other users. CareJan reserves the right to remove any content and suspend any account that violates these Terms. CareJan maintains a zero-tolerance policy for objectionable content.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
CAREJAN DOES NOT SCREEN, VET, CERTIFY, OR GUARANTEE ANY CAREGIVER. CAREJAN MAKES NO REPRESENTATIONS ABOUT THE QUALIFICATIONS, RELIABILITY, OR TRUSTWORTHINESS OF ANY USER. FAMILIES ARE SOLELY RESPONSIBLE FOR CONDUCTING THEIR OWN DUE DILIGENCE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAREJAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE APP.
You agree to indemnify, defend, and hold harmless CareJan LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the App or violation of these Terms.
These Terms shall be governed by the laws of the State of California. Any disputes shall be resolved in the courts of Orange County, California.
CareJan reserves the right to modify these Terms at any time. We will notify users of material changes through the App. Continued use constitutes acceptance of updated Terms.
